The Supreme Court delivered a setback to the Environmental Protection Agency on Monday, placing limits on the sole Obama administration program already in place to deal with power plant and factory emissions of gases blamed for global warming.

Today the Supreme court said loud and clear that the MT suit HMWAIC in the White House overstepped his powers with recess appointments to the NLRB two years ago.

National Review is reporting that this is the 13th unanimous ruling that the Big O has lost in 5 years.    

As George Mason University law professor Ilya Somin told the Washington Times last year, “When the administration loses significant cases in unanimous decisions and cannot even hold the votes of its own appointees . . . it is an indication that they adopted such an extreme position on the scope of federal power that even generally sympathetic judges could not even support it.”
