The lawsuit was prosecuted by "The Great One", Mark Levin legal group as a friend of the court.

Have no fear the BHO sheep will exclaim other Presidents have made recess appointments.
Look for JT and/or JC say their guy has the right to do it too!
(These two are famous for deflection. One of these two argued the right of executive orders and not the content of such order.)
