Obama Immigration Amnesty Dies
A 4-4 tie by the SCOTUS effectively kills the Obama immigration leaving the 5th US Circuit Court of Appeals ruling striking down Obama's immigration amnesty in effect.
What's that I hear? The wailing and gnashing of teeth by Liberals bitching about the Court not having a full complement of justices? Why don't I hear the same complaints about the Fisher v University of Texas where there only 7 justices taking part in the 4-3 decision favorable to the Obama Admin due to the recusal of Justice Kagan?

Justice Elena Kagan, who would probably have voted with the majority, was recused from the case because she had worked on it as solicitor general.

Even if Garland had been confirmed by now, he wouldn't been part of this decision since he would have missed oral argumentation held on April 18th only 32 days after his nomination. Justice Sotomayor was confirmed and sworn in in 74 days. Justice Kagan was confirmed and sworn in in 89 days.
Nor would Garland have taken part of oral arguments in Fisher v University of Texas since it was argued while Scalia was still alive. And it doesn't matter if Kagan would have voted with the majority because if the SCOTUS had been deadlocked in University of Texas, the use of affirmative action in admissions would have been upheld by the Texas Supreme Court's decision.
The fact remains that when a Supreme Court without a full complement of justices rules in favor of Obama/Liberal causes it's a non-issue but when the same Supreme Court fails to affirm Obama's policies it's a travesty of democracy.
